TERMS OF PURCHASE
GENERALLY
LovelyCapture.com (hereinafter referred to as LC) is a webshop owned and operated by EMSE WEBUNIT AB with registration number 556768-7107. When you shop at LC, an agreement is entered into between you as a consumer (hereinafter referred to as "You") and LC.
18-year-old age limit applies to purchases. LC reserves the right to refuse purchases in cases where incorrect personal data has been provided or if there are payment complaints.
LC reserves itself against any errors such as incorrect product description, pricing or availability. LC reserves the right to correct such errors at any time. In the event of any price adjustment, this must of course be approved by you as the customer before the order is completed.
All images on the page are to be considered as illustrations and cannot guarantee the exact appearance of the item. LC is not responsible for information on the page that comes from third parties.
IMMATERIAL RIGHTS
All content on the site is the property of LC or partners of LC and may not be copied or used without written permission from LC. This includes e.g. images, graphics, design, layout, brand, company name and product information.
ORDERING
To complete a purchase on the Site, you must accept the terms of this Agreement. This means that you also approve our handling of personal data and Cookie Policy. See privacy policy here .
The agreement comes into force when you receive order confirmation. Save the confirmation for any future contact with our customer service. You can withdraw your order until the order is confirmed by LC. In the event of cancellation of an order, LC will refund all payments that may have already been made.
CUSTOMER INFORMATION
When registering a user account or purchasing information, you are responsible for the correctness of the personal data. Personal data is processed according to LC's privacy policy. See privacy policy here
You are responsible for ensuring that no one else has access to your account and your information on the site. If you suspect that someone unauthorized has gained access to your login details, you must report this to LC immediately. You are responsible for all purchases made with your login details if such notification has not been made. LC has the right to suspend accounts that are misused and to assign new login details.
PRICES, FEES AND PAYMENT
Prices for LC are stated including VAT. The product price does not include any shipping or administrative fees. The total amount is always visible in the checkout.
You can pay with VISA, MasterCard, American Express or PayPal. As a business customer, you can also shop against an invoice after the usual credit check.
LC reserves the right to withdraw or change any promotions at any time.
DELIVERY AND TRANSPORT
Normal delivery time is indicated on the LC. However, delivery takes place no later than 30 working days from order confirmation, unless otherwise agreed in writing. If delivery takes longer than 30 days, you have the right to cancel the purchase. Delivery conditions can be found here.
You will receive a notification showing where to collect the package. You are responsible for collecting the package within the time specified in the notification. Always have identification with you when picking up packages. Notification can take place via e-mail, regular mail, SMS or telephone. LC has the right to charge a fee of SEK 195 for packages that have not been picked up.
RIGHT OF WITHDRAWAL
When purchasing goods on LC, a 30-day right of withdrawal always applies according to current consumer protection legislation. The right of withdrawal applies to unopened packaging. In case of cancellation of purchase, this must be communicated via e-mail support@lovelycapture.com . Name, order number and invoice number must appear in the message. You pay return shipping. The item must be returned within 30 days from the day LC receives the message. The item must be sent well packaged in the original packaging. You are responsible for the item being in new condition when it arrives at LC. Instructions for returns can be found here .
In case of cancellation of purchase, LC will refund the entire amount including delivery costs, unless other delivery costs have arisen due to special choices made by you as a customer. When part of an order is returned, delivery costs are not refunded. LC has the right to deduct part of the refundable amount or completely refuse a refund depending on the condition of the goods upon return. LC will refund the amount no later than 14 days after LC received the item in return from you as a customer. When ordering a product without the right of withdrawal, this is clearly stated in the product's description.
WARRANTY AND COMPLAINTS
Some goods on the LC are covered by warranty, this is stated on the LC on the respective product. The warranty only applies to original manufacturing defects and not to defects that occur due to negligence or changes to the product's function or appearance. Your order confirmation is valid as proof of warranty. The right of complaint covers products that are faulty according to current consumer protection legislation. In the event of a complaint, LC must be contacted as soon as possible after the fault has been discovered via the contact details specified on the LC. LC stands for shipping cost in the event of an approved complaint.
Compensation/reimbursement in the event of an approved complaint normally takes place no later than 14 days after LC has received the item in return, and in accordance with current consumer protection legislation. However, it may take longer depending on the type of product. LC reserves the right to refuse a complaint if the product is not faulty according to current consumer protection legislation. LC follows guidelines from the Allmänna Reklamationsnämnden ( www.arn.se ). More information is available at www.konsumentverket.se.
LINKS AND SECURITY
LC may contain links to websites outside of LC's control. LC strives to only link to websites that adhere to the same personal data and privacy policy as LC. LC is not responsible for personal data that you share on other pages.
FORCE MAJEURE
LC is not responsible for delays or non-delivery caused by circumstances beyond LC's control. This includes, for example, causes such as general labor conflict, war, state of emergency, extreme weather, fire, changed authority regulations, faults in electricity/telecommunications/data connections and if LC's subcontractors have been affected by similar circumstances. These circumstances mean that LC is completely exempt from damages. LC will notify to the extent possible and communication availability if such a situation arises. If the situation lasts longer than two months, both parties have the right to cancel the purchase with immediate effect.
CHANGES TO THE TERMS
LC reserves the right to change the terms of this Agreement at any time. All changes are considered valid when the terms are published on LC. Changes apply when you accept the terms upon new purchase or 30 days after LC informs you of the changes.
INVALID AGREEMENT
If a court, authority or arbitration panel should find any provision of these terms invalid or unenforceable, that provision and all other provisions shall be valid and enforceable to the extent permitted by law. The clauses declared invalid or unenforceable will be replaced by relevant legal guidance and advice.
APPLICABLE LAW AND DISPUTE
Disputes must primarily be resolved in agreement with LC's customer service. If a dispute cannot be resolved in agreement with LC, you can turn to the General Complaints Board, www.arn.se. You can also submit a complaint to the European Commission's platform for disputes at ec.europa.eu/consumers/odr. The case is then automatically forwarded to the appropriate nationally responsible dispute resolution body. This body then contacts us in an attempt to resolve the dispute without court involvement. A dispute regarding the interpretation or application of the terms of this agreement shall be interpreted in accordance with Swedish legislation and settled as mentioned above or in the last instance by a general court.
